Responsibility of parents is the future of children!

Simple words that make you think in certain situations – responsibility for the improper children upbringing. This measure of a state-coercive nature is applied to legal representatives (parents or persons substituting for them) who have violated their upbringing obligations. This carelessness can lead to adverse consequences for parents, which can be expressed in state and public condemnation. Please note that, in accordance with Art. 942 of the Civil Code of the Republic of Belarus for harm caused to teenagers under the age of fourteen (minors), his parents, adoptive parents or guardians are responsible. The parents’ obligation to compensate for harm does not stop when the minor reaches the age of majority or receives property sufficient to compensate for harm. In the modern society realities, more and more conflict situations are observed within families, the child takes more and more negative experiences into everyday life, which does not allow him/her to develop properly as a person. It is important to understand that taking care of children and their upbringing is the main responsibility of parents. In cases where parents or persons substituting them do not fulfill their direct duties properly in relation to their own children, measures of legal responsibility are applied to such parents, provided by the current legislation and correlated with different levels of responsibility: family, administrative, civil and criminal. Family and legal responsibility: Parents are obliged to take care of the physical, spiritual and moral development of children, their health, education and preparation for an independent life in society (Art. 75, Code of the Republic of Belarus on Marriage and Family). If upbringing does not allow the basic needs of the child to be realized, then the child and the family are considered to be in a socially dangerous situation.

Administrative responsibility: the following administrative penalties are applied to parents and persons substituting them: a warning, imposition of obligations to eliminate the harm caused, or the imposition of a monetary fine. Such measures are applied under the following conditions: Article 9.4 of the Code of the Republic of Belarus on Administrative Offenses provides liability for the failure of parents or persons replacing them to fulfill their responsibilities for raising minor children, which entailed the commission of an act by minors under the age of sixteen that contains signs of an administrative offense, or a crime, administrative or criminal liability for which occurs after reaching this age. The sanction of this article calls for the imposition of a penalty in the form of a fine of up to ten basic units;

Article 18.23 of the Code of Administrative Offenses of the Republic of Belarus calls for liability for violations of traffic rules by adolescents under the age of 16;

Article 17.3 of the Code of Administrative Offenses of the Republic of Belarus calls for liability for the appearance of children in public places drunk, as well as for their drinking of alcoholic beverages or in connection with the commission of other offenses.

Criminal liability to parents and persons substituting them is applied in the following cases: Article 173 of the Criminal Code of the Republic of Belarus calls for criminal liability for involving a minor in the systematic use of alcoholic beverages and intoxicating substances; Article 173 of the Criminal Code of the Republic of Belarus calls for criminal liability for involvement in prostitution, vagrancy or begging; Article 174 of the Criminal Code of the Republic of Belarus calls for criminal liability for evading payment of funds for the maintenance of children. Civil liability: if a child under the age of 14 has caused damage to property or health to others, his parents and their substitutes are directly responsible and accountable for this. Deprivation of parental rights: in the course of court proceedings, parents may be deprived of parental rights (in accordance with Article 80 of the Code of the Republic of Belarus on Marriage and Family) if they evade the obligations of parents, including paying alimony, for abuse of parental rights, etc. If a threat to the life and health of the child is identified, the commission on juvenile affairs makes a decision on the removal of the child from the family. According to Article 82 of the Code of the Republic of Belarus on Marriage and Family, deprivation of parental rights does not relieve parents of their responsibilities for raising a child. It is important to remember that the rights and responsibilities of raising children on the part of parents are directly based on the moral and ethical component of development. The stronger this foundation, the more careful the attitude of parents to their children, the less manifestations of trouble and neglect can be observed in society.
